Terms of Sale

1. Who you are buying from

Montana Property Reports, LLC is a Montana limited liability company based in Livingston, Montana ("we", "us", "our"). These terms are an agreement between you and Montana Property Reports, LLC. We are independent. We are not affiliated with, endorsed by, or acting on behalf of the State of Montana, any of its agencies, or any federal agency whose public records this service draws on.

2. What you are buying

You are buying access to a conditions-information service, The Montana Angler's Almanac: its scored, hour-by-hour outlook for the Montana rivers it models, saved waters and alerts, for the period you pay for. You are not buying the public records and instrument readings themselves, which are public, and you are not buying a guarantee about conditions, access or fish. What each product covers, and what it cannot settle, is set out in the product schedule below and on this site's Product Disclaimer page, which forms part of these terms. There is no property report and no PDF.

3. Delivery

Access is immediate: you are signed in on the device you pay from the moment payment completes, and a sign-in link is sent to your email for any other device. There is nothing to download. If sign-in does not work within 24 hours of payment you get a full refund without asking.

4. Price, payment and subscriptions

Prices are shown on this site before purchase and are charged in US dollars through Stripe. We do not see or store your full card number.

The yearly and monthly memberships are billed in advance and renew automatically at the same interval until you cancel. The amount, the interval and the first renewal date are shown before you pay, and the renewal price and date are shown in your account. The Fishing Season Pass is a single payment: it does not renew and leaves no card on file. You can cancel a membership at any time from your account page; cancellation takes effect at the end of the current billing period, and partial periods are not pro-rated except as the Refund Policy below provides. We will tell you before any price change applies to your renewal.

Prices may change. A change never affects a purchase already completed.

5. Refunds

Our Refund Policy, also published on its own page, is part of these terms:

Only the product types actually offered on this site apply. A reference to renewal payments does not create automatic renewal for a one-time report or a nonrenewing pass.

If a purchase is not useful to you, request a full refund of the applicable payment within the window below. No explanation is required. Downloading a report, viewing content, or using included features during the window does not by itself disqualify you.

For one-time reports, request a refund within seven calendar days after the report is first delivered or made available to you. For initial memberships and seasonal passes, request a refund within seven calendar days after the purchased access or benefits become available; the window does not begin before the purchased service is available.

Each renewal payment has its own seven-calendar-day window beginning on the later of the renewal charge date and the date access for that renewed period becomes available. Access remaining from an earlier paid period does not start the new period's refund window early.

Submit your request through this site's published refund or contact channel, or email matt@paradisevalleymedia.com with enough information to identify the purchase. The deadline is 11:59 p.m. Mountain Time on the seventh calendar day after the triggering date. A request received by that deadline qualifies even if processing occurs later.

Refunds go to the original payment method unless another method is legally required or agreed; bank processing times can vary. Canceling future renewal and requesting a refund are separate actions. You may request either or both, and we will confirm the actions taken.

After the satisfaction window, we do not promise discretionary change-of-mind refunds or prorated refunds for an unused portion of a billing period. You may still cancel future subscription renewals. This does not affect refunds or other remedies required by applicable law.

Failure to deliver as promised, duplicate or unauthorized charges, materially misdescribed products, and other legally protected claims are not extinguished by this seven-day deadline. Any more favorable express delivery or refund promise made for your purchase also applies.

6. What this service is not

7. Accuracy and the limits of the source data

We do not create the underlying records and cannot warrant their accuracy or completeness. Government datasets carry their own scale limits and their own lag, and the How this works page states them. Where the record is thin, our pages say so and lower their stated confidence. We do not fill gaps with invented text. If you believe a figure is wrong, tell us: we would rather correct it than defend it.

8. Acceptable use

You agree not to:

Sharing a day's outlook with the people you fish with, or with your own clients if you guide, is expected and permitted.

9. Limitation of liability

To the maximum extent the law allows, our total liability arising out of a report or your use of these services is limited to the amount you paid us for it, and for subscriptions, to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, consequential or punitive damages, including lost profits, a failed transaction, a dry hole, drilling or construction costs, or a change in property value.

This is a cap, not an escape. It reflects what the product honestly is: we charge tens of dollars to organize public records, and we cannot underwrite a land purchase, a drilling program or a building project.

The services are provided "as is", without warranties of any kind, except as stated in section 10.

10. Rights we do not limit

Nothing in these terms limits or waives:

If any part of these terms is held unenforceable, the rest continues to apply.

11. Changes

We may change the services and these terms. A material change is reflected in the effective date above and applies to purchases made after it is published. A purchase you have already made keeps the terms you accepted, and access you have already paid for continues to the end of its period.

12. Governing law

These terms are governed by the laws of the State of Montana, without regard to its conflict of law rules.

Montana Fishing Report Product Schedule (The Montana Angler's Almanac)

Products. Fishing Season Pass, $19.99, one time, from purchase through November 30 of the year bought; it does not renew. Member, yearly, $29, renewing automatically each year until cancelled. Member, monthly, $4.99, renewing automatically each month until cancelled. Shop & Guide, $149 a year, renewing automatically each year until cancelled, arranged by hand.

What it covers. Membership in a conditions service, not a report: the full six-day, hour-by-hour Fishing Score and best-window outlook for the Montana rivers the almanac models, saved waters, and alerts by email, read hourly from USGS gauges, National Weather Service forecasts and Montana Fish, Wildlife & Parks restriction and survey data. The best reach on each river today, hour by hour, and every rule, closure, hoot-owl restriction, access site and thermal caution stay free for everyone; a membership never gates safety or legality.

Delivery. Immediate on screen: you are signed in on the device you pay from, and a sign-in link is sent to your email for any other device. There is no PDF. If sign-in does not work within 24 hours of payment you get a full refund without asking.

What it cannot settle. It is not a promise of fish. Scores are estimates from public instruments, labeled measured, proxied, estimated or forecast, and a high score is a statement about conditions, not about your catch. It is not a safety service and does not warn of every hazard. It is not the fishing regulations: Montana Fish, Wildlife & Parks regulations, closures and restrictions govern, and you must follow them whether or not the almanac displays them. It names no fishing spots; access is by public fishing access sites.

Renewal and cancellation. Yearly and monthly memberships renew automatically at the price shown in your account until you cancel, which you can do at any time from your account page; the membership then runs to the end of the period already paid for. The Season Pass does not renew and leaves no card on file.

Refunds. Every payment, including each renewal, carries the Seven-Day Satisfaction Refunds window in section 5: ask within seven calendar days of the purchased access becoming available (for a renewal, within seven calendar days of the later of the charge and the start of the renewed period) and the payment is refunded in full, no reason needed. The 24-hour sign-in commitment above is separate and more favorable.

Free tier. Each day, the best-scoring open reach on every river the almanac models, with its full hour-by-hour outlook, and all regulations, restrictions, closures and access information are free and need no account. The other reaches' hours that day, and every later day, are for members.
